1. Agreement to Terms
By accessing or using the Cozy Sites website (cozysites.me) or subscribing to our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.
Cozy Sites is operated by Cozy Empire ("we," "us," or "our").
2. Services
Cozy Sites provides website design, hosting, and maintenance services for small businesses. Our service includes:
- Custom-built HTML website
- Mobile responsive design
- Web hosting
- Domain name (included with subscription)
- Content edits and updates
- Contact form setup
- Ongoing technical support
3. Subscription & Billing
Our service is offered on a monthly subscription basis at $24.99/month. By subscribing, you authorize us to charge your payment method on a recurring monthly basis through our payment processor, Stripe.
- No setup fees. There are no upfront costs to get started.
- No contracts. You may cancel your subscription at any time.
- Cancellation. If you cancel, your website will remain active through the end of your current billing cycle. After that, your site will be taken offline.
- Refunds. We do not offer refunds for partial months of service. If you cancel, you will not be billed for future months.
- Price changes. We reserve the right to change pricing with 30 days' advance notice via email.
4. Website Ownership & Content
- You retain ownership of all content you provide (text, images, logos, etc.).
- We retain ownership of the underlying website code and design templates.
- We may display a "Website built by Cozy Sites" credit in the footer of your site.
- Upon cancellation, you may request a copy of your content. Code and design assets are not transferable.
5. Your Responsibilities
You agree to:
- Provide accurate and complete information during onboarding.
- Ensure that all content you provide does not infringe on any third-party rights.
- Not use our services for any unlawful, harmful, or fraudulent purpose.
- Not submit content that is defamatory, obscene, hateful, or threatening.
- Respond to our communications in a timely manner during the website build process.
6. Referral Program
Our referral program allows you to earn $2.50/month for each referred subscriber who remains active. Referral terms:
- Referred subscribers receive a discounted rate of $20/month for their first 3 months.
- Referral earnings are paid monthly via PayPal or Cash App.
- We reserve the right to modify or discontinue the referral program at any time with notice.
- Abuse of the referral program (fake accounts, self-referrals, etc.) will result in forfeiture of earnings and possible account termination.
7. Service Availability
While we strive for maximum uptime, we do not guarantee 100% availability. We are not liable for any downtime caused by hosting providers, DNS issues, third-party services, or circumstances beyond our control. We will make reasonable efforts to resolve any outages promptly.
8. Limitation of Liability
To the maximum extent permitted by law, Cozy Sites and Cozy Empire shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, data, or business opportunities, arising from your use of our services.
Our total liability shall not exceed the amount you paid us in the 3 months preceding the event giving rise to the claim.
9. Termination
We reserve the right to suspend or terminate your account and website if:
- You violate these Terms.
- Your payment method fails and is not resolved within 7 days.
- You use the service for unlawful purposes.
- Your website content violates our acceptable use standards.
10. Modifications to Terms
We may update these Terms from time to time. We will notify subscribers of material changes via email. Continued use of our services after changes take effect constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of the United States and the State of Kentucky, without regard to conflict of law principles.
